关于音著协与百度公司建立音乐版权合作的背景情况介绍
2011年3月31日，音著协与百度公司就百度公司网络音乐作品的授权使用问题达成战略合作，双方同意发挥各自优势，共同建立网络音乐作品授权主渠道，以推进网络音乐的正版化进程。针对业界关注，协会现向社会各界介绍音著协与百度公司多年来维权沟通工作的背景情况。
音著协早在2005年就同百度公司就相关的音乐著作权问题进行过多次交涉；在交涉未果的情况下于2008年1月就百度公司侵犯音乐著作权问题向北京市海淀区法院提起诉讼，并同时向百度发起维权宣传攻势；2008年7月又联合音像权利人发起“品牌广告主拒绝百度”宣传活动；2010 年2月海淀法院一审判决协会胜诉，百度公司不服提起上诉，2010年7月北京高院二审终审判决协会胜诉，这是所有音像种类权利人针对百度众多的维权诉讼中唯一的一起权利人胜诉的案例；同年11月百度公司与协会启动全面谈判；经过几个月的艰苦谈判，双方终达成合作。
此次合作的基本架构内容是：音著协与百度公司共同打造互联网词曲著作权授权主渠道，百度公司利用协会作为著作权集体管理组织的广泛代表性全面解决全球范围内的音乐作品所涉的词曲著作权问题，百度公司则利用自己的网络推广平台向用户合法地传播音乐作品，双方各自发挥自己的资源优势共同推动中国网络音乐正版化的发展。
此次合作成功是在国家促进知识产权保护的大背景下，在国家和地方版权行政管理部门的督促下，使用者自觉遵照《著作权法》的规定,履行版权法律义务的成功范例。双方的合作开创了中国互联网音乐正版化的先河，对于保护互联网环境下广大音乐著作权人的合法权益和实现使用者与权利人的利益平衡具有标杆性的历史意义。
Background Information on Music Copyrights Cooperation Between MCSC and BAIDU,Inc.
On March 31st, 2011, MCSC and BAIDU reached an agreement to carry out strategic cooperation on Internet
music copyright licensing. Both sides agreed to demonstrate their superiorities and join hands in establishing
Platforms conducive to Internet music copyright licensing on the purpose of promoting the process of music
copyright protection. Concerned with public focus on this matter, MCSC decides to introduce background
information about following years’ communication works on music right protection between MCSC and
BAIDU.
Early in 2005, MCSC took to negotiate with BAIDU on relevant problems with music copyright protection
many times. Without reaching any agreement, MCSC sued BAIDU for its tortuous damage to music copyright
to Beijing Haidian People’s Court, and launched campaigns to advocate music copyright protection at the same
time. In July, 2008, MCSC joined with music copyright owners to participate the Brand Advertiser’s Refusal
to BAIDU Activity. In February, 2010, Haidian People’s court of first instance judged MCSC to win the case.
BAIDU had an objection against order and filed an appeal, but Beijing High Court ,the court of second instance
affirmed the original judge. This case is the first successful one after countless failure of other music copyright
owners who tried to sue BAIDU for its tort liability. In November, 2010, MCSC and BAIDU carried out
negotiations in an all round way. After arduous negotiations, both sides finally reached the agreement on
cooperation.
The main structure of cooperation is about: MCSC and BAIDU jointly establish a leading channel for on-line
music composers’ and authors’ copyright licensing, BAIDU has to solve overall problems arousing from on-line
music composers’ and authors’ copyright licensing through cooperation and agreement with MCSC as a broadly
representative collective management organization, and take advantage of its resource to disseminate music
works to legal users, and MCSC and BAIDU make a joint efforts to play their roles in promoting development
of music copyright protection.
This successful agreement between MCSC and BAIDU is reached at a time when the Chinese government is
promoting to protect intellectual property and it sets a good example as the user is aware of complying with
the copyright law and shouldering the responsibility under both central and local Copyright Administrations’
supervision. Cooperation between MCSC and BAIDU is a milestone in protecting music copyright and a
historically significant anchor to protect on-line music copyright owners’ legal interests and realize the interests’
balance between on-line music users and music copyright owners.
