协会与百度公司正式达成战略合作协议
继协会于2011年3月底与百度公司达成关于网络音乐词曲著作权合作的框架备忘之后，经过近期紧锣密鼓的后续协商，双方终于在近日正式签署战略合作协议，并在中国中央电视台法制与社会频道的2011年4.26绿书签行动晚会录制现场进行了合同文本交换仪式。自此，协会与百度公司正式确立网络音乐词曲作品著作权的战略合作关系。根据双方的协议，百度公司将其音乐栏目传播的音乐在线播放和下载数据定期提供给协会，并按照其目前与既有合作单位多年实施的计费标准，将相关音乐词曲著作权使用费支付给协会，并由协会转付给相关权利人，共同建立网络音乐词曲著作权正版化主渠道。
众所周知，当今网络音乐的使用一般都属于海量作品使用，互联网企业要想与浩如烟海且分布在全球各地的音乐个体著作权人一一通过谈判对价和签约来逐个解决著作权问题是在技术上难以实现的；同时，互联网公司也无法全面有效鉴别核实所使用作品的版权权利，上述这两个授权难题长期得不到有效解决。在这种情况下，协会作为中国唯一的音乐著作权集体管理组织，凭借自身世界范围的音乐作品权利代表性和与海外联网的作品版权信息系统的国际通用性，可以有效解决互联网企业海量音乐作品使用的授权付费难题，使得广大原创作者切实获得网络著作权收益。
经过协会多年不懈的维权努力，百度公司与协会终于达成上述合作。双方此次合作的基本着眼点就在于不纠结历史，而是把工作重点放到对未来问题的解决上，共同承诺充分发挥各自在作品权利资源上和网络传播平台上的优势，共同打造中国网络音乐作品正版化主渠道，以促进互联网环境下权利人与使用者之间的利益平衡。
此次合作是在中国知识产权保护不断进步的大背景下，在国家和地方版权主管机关的关心帮助下，双方经过长期耐心细致的谈判所取得的历史性成果。双方确信此次合作必将加快中国网络音乐全面正版化的步伐，对于在网络全行业树立和推广正版化经营模式具有示范效应。
Strategic Cooperation Agreement Reached
Between MCSC and BAIDU, Inc
Right after the framework Memorandum on on-line music composers’ and authors’ copyright cooperation
between MCSC and BAIDU in the late March, 2011, both sides lost no time to carry out follow-up
negotiations and finally signed the formal strategic cooperation agreement. The agreement document exchange
ceremony was held at the Green Bookmark Action Evening Party of April 26th of 2011 on CCTV-12
(Law and Society Channel). From this important moment on, MCSC and BAIDU formally established
strategic cooperation partnerships of on-line music composers’ and authors’ copyright licensing.
According to the agreement, BAIDU periodically provides MCSC with data of on-line music streaming
and downloads on its MP3 website and pay relevant music copyright licensing fee to MCSC based on
existing licensing fee standard, and MCSC is responsible for transferring the fee provided by BAIDU to
copyright owners. Both sides are committed to establishing a leading channel for on-line music
composers’ and authors’ copyright licensing.
As we all know, it is technically impossible for internet enterprises to contact all music copyright owners
one by one to solve problems in music copyright licensing while on-line music works are currently widely
used. At the same time, internet enterprises have no way to effectively indentify all copyright owners as they
use on-line music works. Above-mentioned problems are unsettled for a long time. As the only collective music
copyright management organization in China with its broad representativeness of music copyrights all around
the world and its universal international networking system of music copyright information, MCSC is capable
of effectively solving problems in on-line music copyright licensing and helping countless music composers
and authors to gain their internet copyright profits.
Through years of persistent efforts, MCSC and BAIDU reached final above- mentioned agreement. Both
sides devote themselves to look into the future and solve existing problems without trapping in the past.
MCSC and BAIDU will demonstrate their superiorities of music works resources and on-line dissemination
platforms, and make a joint effort to play their roles in promoting development of music copyright protection
on the purpose of realizing the interests’ balance between music copyright owners and on-line music users.
This successful agreement is reached at a time when the Chinese intellectual property protection is increasingly
enhanced. With cares and assists of both central and local copyright administrations, MCSC and BAIDU have
achieved historically significant accomplishments through long-term careful and delicate negotiations. Both sides
are assured that the cooperation will surely accelerate the development of Chinese on-line music copyright
protection and set a good example for the whole internet industry to apply an operation mode of using licensed
music works.
